Terms and Conditions

Thanks for choosing BlueSky Charters, Please find below the terms and conditions (Terms) upon which we, BlueSky Charters Inc., will provide our services to you. Please read the Terms carefully and ensure to understand. Please note that by using our service, you agree to be bound by these Terms and conditions.

The client while upon receiving trip tickets (confirmations) verifies that the address, pickup date, time number of passengers and the billing information are correct.

The client understands h time starts at contract (reservation) agreed time, if the client is late or board the vehicle later than agreed (reservation) time, that time would not be considered as the start time. Start time will remain the same as reserved or documented in Trip Confirmation(s). Any additional time will be counted towards overtime charges, as outlined in overtime section.

The client understands that the drivers are not authorized to make any billing-related decisions. So any discussion with the driver regarding the billing hours and charges will be considered invalid.

Harassment & Verbal Abuse:
BlueSky Charters maintains a zero-tolerance policy for harassment and verbal abuse. Any form of harassment or verbal abuse directed at our staff and driver will result in the immediate termination of the service. No refunds will be issued in such cases.

Insurance / Liability:
BlueSky Charters does not assume liability for products or services not produced or supplied by BlueSky Charters. In addition, BlueSky Charters does not assume liability for items placed in the luggage compartments or left unattended in the coach. BlueSky Charters reserves the right to decline, accept, or retain any passenger unless prohibited by applicable law.

Coach Condition:
BlueSky Charters reserves the right to require a damage deposit in the form of advanced funds or a credit card pre-authorization on file for the deposit amount and will impose a surcharge should damage caused by the client or their guests require special cleaning or repairs.

Alcohol:
BlueSky Charters will allow the consumption of alcohol on the motorcoach provided the advance permission has been granted and the proper consumption permits and licenses are in place. All costs associated for the purchase of any required permits or licenses are the sole responsibility of the customer.

Lost and Found:
Clients understand that all lost and found items will be kept in the office for 90 days. The client must claim items in 90 days period.

Post Trip Billing:
All Charter services are subject to a final accounting audit. Post Trip Billing will reconcile actual mileage and hours of service and charge accordingly for any excess over the estimate.

Winter Weather Cancellation:
BlueSky Charters reserves the right to cancel trips due to unsafe road conditions or temperatures colder than -20°C. Safety is our top priority, and we do not operate under unsafe conditions, such as frigid temperatures, snowstorms, or travel advisories.

Luggage:
All belongings must fit safely in the luggage compartment or overhead compartments. Excess luggage will be turned down for safety reasons. Confirm luggage capacity at the time of booking.

Wi-Fi:
Wi-Fi is a complimentary service available upon request. No refunds will be issued for non-working Wi-Fi. If high-speed paid Wi-Fi is requested, a refund will be processed if service is lacking from our end. Slow or no internet due to satellite connection issues will not be refunded.

Gravel / Unpaved Roads:
BlueSky Charters does not travel on gravel, unpaved, or dirt roads—no exceptions—unless prior arrangements are made in writing and such routes are included in the itinerary. A detailing and sanitization fee of up to $2,500 will apply. Additionally, the client booking party understands they will be responsible for any tow recovery charges or damages incurred if the bus becomes stuck or breaks down on unpaved or gravel roads. Gravel and rocks can damage the radiator, air-to-air system, and other components, which can result in damages of up to $25,000 or more.

Overnight Driving:
For safety and to prevent driver fatigue, BlueSky Charters drivers do not operate vehicles between 2:00 a.m. and 5:00 a.m. Itineraries must be adjusted accordingly, and necessary accommodations must be arranged for overnight stays. The client understands that the drivers are not authorized to make any billing-related decisions. Any discussion with the driver regarding billing hours and charges will be considered invalid.

Novation and Waiver:
By signing this Agreement, and as part of the consideration to BlueSky Charters, you acknowledge and agree that BlueSky Charters is under no obligation to limit or restrict its business relationships or activities with any of your current or former customers, business partners, affiliates, or any third parties, including governmental, non-governmental, or non-profit organizations, regardless of any prior contractual agreements to the contrary, if they exist. BlueSky Charters retains the unrestricted right to engage in business, directly or indirectly, with any such parties at its sole discretion, now or in the future.

You further acknowledge that BlueSky Charters is not, and shall not be, bound by any non-compete, non-solicitation, or referral agreement obligations—whether arising from any prior, existing, or future agreements, including those you may have presented or may present to BlueSky Charters. Any such provisions shall be deemed null and void. Your acceptance of this Agreement constitutes a full and irrevocable release of BlueSky Charters from any such restrictions, and you have had an opportunity to obtain legal advice, as this contract affects your rights, and potentially rights of prior agreements with BlueSky Charters.

Further, by signing this Agreement, you agree that any past, present, or future dispute shall be decided by the Courts of Alberta, in Alberta, Canada, and no other forum has any jurisdiction over any past, present, or future dispute, including in relation to any other contract the parties may have requiring arbitration, and this clause novates into any prior, present, or future agreements between the parties. The signatory has the authority to bind the corporation for which they sign.

It is understood and agreed that BlueSky Charters would not provide services unless the above terms are legally binding and both parties acknowledge the valuable consideration herein.

2. Our Services

2.1. BlueSky Charters provides transportation services (the “Service”), which means we will provide a fully operational and serviced vehicle along with a driver. The use of these transportation services will be in accordance with all applicable local laws and regulations, including traffic, parking, vehicle safety, and driver hours-of-service requirements, at all times.

2.2. By hiring our Service, you will enter into a contract for the hire of the vehicle and driver’s services as described in your booking confirmation.

2.3. We may hire subcontractors to provide you with the Service; however, this will not affect your rights or our obligations under these Terms.

3. Your Responsibilities

a) If you are the booking person, you confirm that you are at least 18 years old.

b) If you are not the booking person, you confirm that you have the authority to bind any business on whose behalf you are arranging these services.

c) If you are making the booking on behalf of a group, you will be the person accepting these Terms. You will be responsible for ensuring that all persons traveling within your group comply with these Terms. Should they fail to do so, you will be liable to BlueSky Charters for any loss or damage caused to either party arising out of any failure to comply with these Terms.

d) You will notify BlueSky Charters of any changes to your address or contact details arising after acceptance of your booking.

e) You will comply with any restrictions applicable to the Service, including but not limited to the number of passengers.

f) You will be at the designated pick-up address as set out in your Booking Confirmation on the date of service.

g) You undertake at all times to comply with these Terms, in particular in relation to conduct required during the Service. Failure to comply with such Terms will permit the driver to cease providing the Service and to eject you, or all or any of your fellow passengers, from the vehicle.

h) BlueSky Charters will require information from you to enable us to arrange these services. You are responsible for the accuracy of such information.

4. Booking

a) Please note that the images of the vehicles displayed on the BlueSky Charters website are for illustrative purposes only. The actual vehicle provided on the day of service may vary from the vehicle displayed on our website but will be of the specification set out in your Booking Confirmation.

b) A booking is not confirmed without receipt of the required deposit or approved alternate payment arrangements. Full and final payment is due eight (8) weeks prior to departure or at the time of booking.

5. Cancellation & Changes to Booking

a) 50% deposit is required at the time of booking to confirm the reservation with BlueSky Charter. You may request a change to your booking at any time 8 weeks prior to your pick-up date. Requests for changes must be submitted to BlueSky Charter by email only.

b) Additional charges may incur for changes to your itinerary. BlueSky Charter will notify you in writing of the revised charges. If we are unable to arrange the requested changes to your booking or if the revised charges payable for the revised services are not acceptable, you may cancel your booking in accordance with the cancellation policy.

c) You may cancel your booking 8 weeks before departure without any charge. Any amount received will be refunded. Cancellations made with less than 8 weeks’ notice will be subject to a full no-refund policy. No refunds will be issued for no-shows or partial cancellation of the trip.

6) Service Charges and Payment:

a) Pricing & Payments:
i) In consideration of the provision of our Services, BlueSky Charter will charge you the service fee (Quote) as set out in the Booking Confirmation. The quote is based on the current information about the trip (timings, mileage, trips, number of passengers) as provided by you. Any change in those elements will change the above price and may be subject to an additional charge.

ii) For day-rate bookings, quotes are based on an 11-hour service day, calculated on a garage-to-garage basis. Any additional time will be subject to an hourly rate added to the invoice (unless a different end time is specified in your contract).

For daily round trips, daily shuttle services, and A-to-B transfers, only the time specified in the contract will be honored. Any additional wait time will be charged as outlined in the overtime section. No additional stops or route changes are permitted.

iii) Mileage pricing is based on city-to-city travel. Any additional shuttling will be subject to extra charges, either based on mileage or hourly rates.

iv) Payments may be made by credit card, cheque, EFT, cash, or online/email transfer. Payments made by credit card will incur an additional 4.0% fee.

b) Driver’s Accommodation:
While on the charter, the customer (booking party) is responsible for booking and paying for each driver’s separate room accommodation unless alternate arrangements have been made and agreed upon in writing with BlueSky Charter.

c) Parking / Road Tolls / Ferry Costs:
The customer is responsible for all parking, road tolls, and ferry costs. Coach bus length is up to 46 feet.

d) National Park User Fee:
The customer is responsible for all National Park user fees when entering any National Park. A National Park fee of $11 per person will be billed per day. Personal passes are not valid or acceptable when traveling on a commercial carrier.

e) Damage, Garbage, and Cleanliness:
The customer is responsible for any beyond-normal cleaning, liquid spills, and damages done to the coach(es) by passengers during the charter and will be billed for all related repairs. An additional clean-up charge will be applied for spills on seats involving drinks, food, vomit, or similar materials. A charge of $500 will apply for any bodily fluids.

f) Smoking, Use of Controlled Substances, and Liquor:
All BlueSky Charter vehicles are smoke-free. We strictly prohibit the carrying or use of any controlled substances. Liquor may be consumed onboard only with prior arrangement and in accordance with all applicable laws.

g) Driver Gratuity:
The standard driver gratuity for BlueSky Charter is 8% and will be added to the invoice.

h) Overtime:
The client understands that any overtime exceeding 15 minutes will be charged in half-hour increments.

Overtime or wait time will be charged as follows, in 30-minute increments:

Shuttle Van (Ford Transit – 12–14 Seater): $90 every 30 minutes

Mini Bus (25 Seater): $120 every 30 minutes

Mini Coach (30 Seater): $130 every 30 minutes

Motor Coach (Prevost / MCI): $145 every 30 minutes

i) Airport Parking & Other Entry Fees:

Calgary Airport: $110 every 60 minutes

Edmonton Airport: $60

Vancouver Airport: $50

j) Driver Switch:
A driver switch fee of $500 will apply. Additional travel charges may apply if the switch is required outside of our base location. Accommodation and flight tickets will be additional if extra drivers are required for long-distance runs.

k) Charter Pricing and Hours of Service:

  • Estimates:
    Charter pricing is based on mileage, route information, and hours-of-service charges. Deferred cleaning or refueling may also result in additional charges.
  • Regulatory Compliance:
    BlueSky Charter complies with Transport Canada and U.S. DOT regulations, which require all itineraries to be reviewed for hours-of-service compliance. A finalized itinerary must be submitted at least seven (7) business days prior to dispatch. Any significant itinerary changes must be communicated in advance and approved. Adjustments may be required due to travel conditions impacting driver hours of service, which may result in driver switches and associated charges, including driver accommodation.

7) Hours of Service

a) Federal and Provincial governments have legislated Hours of Service (HOS) regulations that all motor carrier operators, including BlueSky Charter, must strictly follow.

b) Maximum driving hours:
Canada: 13 hours
USA: 10 hours

c) Maximum on-duty hours:
Canada: 14 hours
USA: 15 hours

d) Maximum length of workday:
Canada: 16 hours
USA: 15 hours

e) Operators/drivers must have a continuous 8 hours of rest. No driving is permitted after 16 elapsed hours since the last 8 hours off-duty period.

These regulations are strictly enforced by both the Canadian and U.S. Departments of Transportation. Fines may be issued to the driver, BlueSky Charter, and the customer for non-compliance.

Waiting time spent on the coach or at games, events, or venues is considered on-duty time (except while driving). If the driver transports the group to a venue and then returns to their hotel room until the scheduled pick-up later the same day, the driver is considered off-duty while at the hotel.

8) Our Liability to You

a) BlueSky Charter will under no circumstances be liable to you for any loss of profit, loss of business, business interruption, loss of business opportunity, loss of goodwill, or loss of sales, business, or revenue.

b) BlueSky Charter’s total liability to you in respect of all losses arising under or in connection with this contract shall, in all circumstances, be limited in accordance with applicable laws.

9) Events Outside Our Control

9.1. BlueSky Charter will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations under these Terms that is caused by an event outside our control.

9.2. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs, or other industrial action by third parties; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack; war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster; failure of public or private telecommunications networks; congestion, accident, road blockage, mechanical failure, inclement weather, or criminal activity.

9.3. BlueSky Charter’s obligations under these Terms will be suspended, and the time for performance will be extended for the duration of the Event Outside Our Control. Where such an event affects our ability to provide services to you, we will resume services as soon as reasonably possible after the Event Outside Our Control has ended.

9.4. Mechanical Issues:
BlueSky Charter shall not guarantee refunds if your trip is affected by mechanical or service issues and shall retain, at its sole discretion, the right not to make any refunds whatsoever. If a vehicle supplied by BlueSky Charter develops or experiences mechanical, electrical, or other problems that render it inoperable, BlueSky Charter shall, at its sole discretion, provide you with another vehicle of similar quality and cost to complete the charter. The replacement vehicle shall satisfy BlueSky Charter’s contractual obligation. There shall be no refund when an alternate vehicle is provided.

In the event that one or more electrical systems, including climate control, restroom facilities, radio, television, GPS, or other electronic devices, malfunction, BlueSky Charter’s sole liability in such an instance shall be limited to a five (5) percent credit of the total cost of the charter. Credits are valid for one (1) year after the release form is signed and shall apply only to future charters.

Should BlueSky Charter be solely responsible for a delay or failure to meet time requirements, other than as a result of weather, road, traffic conditions, or other causes outside the control of BlueSky Charter, BlueSky Charter’s liability shall be limited as follows:

For any day trip, liability shall be limited to five (5) percent of the charter cost for a specific vehicle for each 30-minute period that the vehicle is late, starting 30 minutes after the scheduled pickup time. Total liability shall not exceed twenty (20) percent of the total charter cost. Credits are valid for one (1) year after the release form is signed and shall apply only to future charters.

For any overnight trip, liability shall be limited to five (5) percent of the total charter cost for a specific vehicle, divided by the number of days set forth in the Customer’s fully executed final confirmation, for each 30-minute period that the vehicle is late, starting 30 minutes after the scheduled pickup time. Total liability shall not exceed twenty (20) percent of the total charter cost divided by the number of days specified in the Customer’s executed final confirmation. Credits are valid for one (1) year after the release form is signed and shall apply only to future charters.

  • All trips which exceed 16 hours of on-duty time and or 13 hrs of drive time in a 24 hr period require the driver to have eight (8) hours of off-duty time. The customer shall bear all responsibility for ensuring that enough time is built into the travel to arrive at all venues as scheduled. Signature Charters shall not be liable for any incidental, consequential, or special damages, whether foreseeable or not, as a result of such delay. If changes are made to an itinerary after booking, Signature Charters reserves the right to deny changes and or update the price to reflect said changes.

10) Use of Your Personal Information

BlueSky Charter will use the personal information you provide to deliver the Services, process payments for those Services, and inform you about similar products or services offered by BlueSky Charter. We do not share your personal information with any third party.

a) BlueSky Charter may amend these Terms & Conditions from time to time to reflect changes in applicable laws and regulatory requirements or to improve how we provide our Services.
